By this application, applicant seeks relaxation of condition imposed on him vide order dated 24.04.2023. 2.

Applicant is accused in C.R. No. 350/2022, registered with Muktainagar Police Station, District- Jalgaon, for offences punishable under sections 377, 498-A, 504, 506 r/w 34 of IPC. This Court vide order dated 24.04.2023 granted anticipatory bail to applicant by imposing certain conditions. One of the condition is that applicant shall appear at the concerned police station once in a three months during next one and half year and applicant shall furnish security in the sum of Rs. 2 Lakhs. {2} 906-APPLN-919-2024 Applicant submits that he has furnished security and he has been regularly attending the police station. Learned advocate for informant confirms this position.

Applicant and informant being husband and wife have amicably settled the dispute and have obtained divorce by mutual consent before the learned Civil Judge, Senior Division, Bhusawal in Hindu Marriage Petition No. 32/2024 on 06.2.2024. Since, applicant and his wife have settled the dispute, prayer of applicant deserves to be granted.

Criminal Application No. 919 of 2024 is therefore allowed in terms of prayer clause 'C'.

Applicant is permitted to withdraw security amount of Rs. 2 Lakhs deposited by him.
