The excess salary paid was recovered from the pensionary benefits. The amount is deducted from the gratuity / pensionable benefits from the deceased husband of the petitioner.

The learned Advocate refers to the order passed in Writ Petition No. 2344 of 2019 dated 19.03.2019.

We have heard the learned A.G.P.

We are not inclined to grant interest at this stage. However, in case the respondents have

2 wp 10394.2021 deducted the amount from the retiral benefits due to the husband of the petitioner on the ground of excess payment made (Rs.1,22,643/-), then the same shall be refunded to the petitioner preferably within a period of six (06) months.

Writ Petition accordingly stands disposed of. No costs.
