After hearing the learned Advocate for the applicant and perusing the charge-sheet, it appears that in respect of the material that has been sent for forensic analysis to Forensic Science Laboratory (F.S.L.) Aurangabad, in that respect the report has not been given. Learned APP was directed to take instructions in respect of the same. Upon instructions, he submits that the materials which were referred to F.S.L., in 2019 are being taken for analysis and unless there is request from the Court, the said chronology year-wise, cannot be disturbed.

In some other matter we may take up the issue regarding huge pendency of the reports in respect of the material sent for forensic analysis. However, taking into consideration the Sections involved in this matter, we direct the Deputy Director, Forensic Science Laboratory, Aurangabad to give priority to the analysis of the material in the present case i.e. Crime No. 433 of 2022 registered with Kadim Jalna Police Station, District-Jalna, for the offence punishable under Sections 501, 507 of Indian Penal Code and Sections 67, 67(A) of the Information Technology Act, which was sent to them under letter Outward NO.99 of 2023, dated 16th March 2023, and the report be submitted to the trial Court at the earliest, not less than TWO MONTHS.

Learned Advocate for the applicant, when the disinclination is shown to grant any relief to the applicant, upon instructions from the applicant, seeks withdrawal of the application. With the above observations, the Application stands disposed of as withdrawn.
