Heard learned Counsel for the applicant. The respondent, despite service, remained absent. The applicant is seeking transfer of HMP No. 399 of 2021, fled by the respondent-husband for getting divorce from the Family Court, Dhule to the Court of learned Civil Judge, Senior Division, Shahada.

Though the applicant is earning member but she is at present maintaining a son aged about 7 years. There is no oppose to the application and, therefore, considering the convenience of the applicant wife, following order is passed:

{2} mca110.22.odt (A) Misc. Civil Application is hereby allowed.

(B) The HMP No. 399 of 2021, is transferred from the Family Court, Dhule to the Court of learned Civil Judge, Senior Division, Shahada. for disposal according to law. {C} The respondent-husband is directed to appear before the Court of learned Civil Judge, Senior Division, Shahada, on or before 15th March, 2023.
