IN THE HIGH COURT OF JUDICATURE AT BOMBAY,

AURANGABAD BENCH, AT AURANGABAD.

REVIEW APPLICATION (CIVIL) NO. 109 OF 2015 IN WP/9992/2014 KALIDAS SHIVAJIRAO PATIL

VERSUS

STATE OF MAHARASHTRA AND OTHERS .........................

Mr. Ganesh A. Gadhe, Advocate, for the applicant. Mr. S.G. Karlekar, Asst. Government Pleader, for non-applicant nos.1 to 3.

Mr. Girish L. Awale, Advocate, for non-applicant no.4. ..........................

CORAM : S.V. GANGAPURWALA & A.M. BADAR, JJ.

DATE : 15TH JANUARY 2016 PER COURT :

1.

It is argued by the learned Counsel for the applicant that on the basis of the statement made by the learned Counsel for respondent no.4 in the Writ Petition, this Court had disposed of the Writ Petition. However, hearing was only in respect of the change of Head Master and no hearing had taken place in respect of the claim of the petitioner for appointment as a full-fledged Head Master. The Writ Petition was filed for seeking direction against the management to forward proposal of the petitioner for appointment as full-fledged Head Master.

(2) R.A. No. 109 of 2015 2.

Mr. Awale, the learned Counsel for non-applicant no.4, submits that as far as forwarding of the proposal by the management is concerned, the said claim of the petitioner is improper as the petitioner had already given no objection.

3.

The said aspect was not considered while disposing of the Writ Petition.

4.

Considering the above, the order dated 14-1-2015 is reviewed and recalled. Writ Petition No. 9992 of 2014 is restored to its original position. Place Writ Petition No. 9992 of 2014 before appropriate Court. 5.

The Review Application is accordingly disposed of. ( A.M. BADAR ) ( S.V. GANGAPURWALA ) JUDGE JUDGE ................................
