Heard the learned counsel for the applicant.

The applicant was tried hard to get treated from the private hospital though the jail authority was ready to sent him for treatment at J.J.Hospital, Mumbai. To grant the relief to the applicant, an opportunity was granted to him to get the treatment from private hospital and sought the schedule of his indoor treatment. As per the directions of this Court, the applicant was produced before the Doctor at Medicover Hospitals. However, the Medical Officer from that hospital did not mention that he would be treated in their hospital for the so called surgery. On the contrary, he prescribed some pills and advised him to go to the Government Medical College,

904-BA.391-24.odt Aurangabad for certain tests. For want of a specific opinion of the Medical Officer, it was difficult for the Court to decide whether that hospital is ready to treat him. Therefore, learned counsel for the applicant on consulting with the relative of the applicant made a statement that the jail authority may be requested to send him for treatment at J.J. Hospital, Mumbai. 3.

In view of the above statement, the application stands disposed of with a direction that the Superintendent, Chhatrapati Sambhaji Nagar, Central Prison should provide him a medication and medical treatment at the suitable hospital and at J.J. Hospital, if the Medical Officer suggests. (S. G. MEHARE, J.) ...
