Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

Perused the statement of the eyewitness, who was the wife of the deceased. Considering the allegations leveled by her against all accused, it appears that the role attributed to each accused is similar. The similarly situated co-accused have been released on bail. There is no concrete medical opinion as to the cause of the death as the opinion has been reserved. Admittedly, no weapons have been used in the crime. Some of the co-accused went to the hospital with the deceased, which shows their good conduct. The chargesheet has been filed. Considering the facts and circumstances of the case, the Court is of the view that the

913-BA-395-23.odt applicant deserves bail. Hence, the following order :- i) The application is allowed.

ii) Applicant Sunil Prabhudas Pardhe be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in C.R.No.134 of 2022, registered with CIDCO Police Station, District Aurangabad Rural, for the offence punishable under Section 302 read with Section 34 of the Indian Penal Code, on the conditions that, (a) He shall not contact the witnesses till conclusion of the trial.

(b) He shall stay away for three months from Aurangabad city from the date of his release.
