Heard Mr. Bhosale, learned counsel appearing for the applicant and Mr. Joshi, the learned APP for the State.

Allegation against the applicant is that he assisted another accused- Santosh More who is facing charge for the offence punishable under Section 302 of the Indian Penal Code, in escaping from lawful custody. 3.

The learned counsel for the applicant states that there is no role attributed to the present applicant in the alleged crime. Investigation of the 1/2

15apln1222-17.odt offence is already completed and charge-sheet is filed. The applicant is behind bar since 04.02.2017. 4.

Considering the nature of accusation and the fact that one of the offence under section 225 IPC is non bailable and imprisonment is for three years and rest of the offences are bailable, applicant is entitled for bail. Hence the application is allowed. 5.

The applicant shall be released on bail on his furnishing personal bond of Rs.25,000/-(Rupees twenty five thousand) with one solvent surety of like amount. 6.

The applicant shall furnish his present address with documentary proof and shall not leave his ordinary place of residence without permission of the Judicial Magistrate, First Class, Vaijapur where the trial of the present case is pending.

Criminal application is disposed of.
