The learned advocate for the petitioners submits that during the pendency of this petition, first eight petitioners have been transferred from unaided to aided category in the teaching section. Petitioner Nos. 9 to 12 are in the non-teaching category and proposed Section 41-B of the MEPS Rules would apply to these petitioners.

We find that Rule 41-A is identical to the proposed Rule 41-B as regards the nonteaching category. 3.

As such, this petition is disposed off with a direction to respondent No. 3 to abide by the existing rules and consider the case of petitioner Nos. 9 to 12 for transfer from aided to un-aided category, depending upon vacancies available.
