The learned Advocate for the applicant has placed on record a letter dated 28/01/2023 issued by him to the applicant intimating therein that the respondent No.1 who is the contesting respondent in the matter is dead and his legal heirs needs to be brought on record to continue the proceeding.

The letter also indicate that in spite of several attempts to contact the Secretary, he has not provided the necessary information. Therefore, the letter also indicate that he will withdraw his appearance in the event that he does not receive any information as regards the legal heirs of deceased respondent No.1.

The letter is taken on record and marked as Exhibit 'X' for identification.

Since the legal heirs of the sole contesting respondent in the matter is not brought on record, the present petition is disposed of, as abated.
