Learned Counsel Mr. P.B.Kakade for the appellant alongwith appellant Mr. Riyaz Abdul and learned counsel Mr. Mohit R. Deshmukh alongwith officer of the insurance company Mr Irfan Shaikh are present today. They tender on record the terms of settlement which is marked as Exh-X and pray to dispose of this appeal in view of the settlement.

As agreed between the parties, the respondent/insurance company shall deposit an amount of Rs.3,50,000/- towards full and

5.FA-796-2010 -2final settlement of the claim within eight weeks before Motor Accident Claim Tribunal, Aurangabad. The same shall be treated as an undertaking. On depositing, the amount the same shall be disbursed to the appellant/original claimant. First Appeal is disposed of in above terms. Award be drawn accordingly. Return of Pursis be granted.

The appellant and the Legal Services Authority shall intimate today's minutes to the respondent claimant and the stakeholders and their lawyers.
