The learned Advocates jointly submitted that both - husband and wife - desire to cohabit and resolve their differences. It is, therefore, submitted that the matter could be referred to the Mediator on the panel of the Family Court, Aurangabad so as to enable the parties to reconcile. 3.

It is also submitted that these proceedings can be disposed off and in the event the mediation fails, the applicant - wife can renew her request for seeking transfer of Petition No.58 of 2014 from the Family Court at Aurangabad to the District Court at Jalgaon, which would then be decided on its own merits.

In the light of the above, the Misc. Civil Application and the Civil Application are disposed off. The Family Court, Aurangabad shall refer the

MCA/117/2014+ Petition No.58 of 2014 to the Mediator on the panel of the Family Court, Aurangabad within a period of two weeks from today. As per the request of both the sides, made across the Bar, they shall appear before the Mediator of the Family Court, Aurangabad on 10.4.2015 at 11.00 AM and shall thereafter abide by the dates of mediation as may be posted by the Mediator.

Needless to state, in the event the mediation fails, the applicant - wife is at liberty to make a fresh application for seeking transfer of Petition No.58 of 2014 from the Family Court at Aurangabad to the District Court at Jalgaon and the same shall then be decided on its own merits.
