IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.2988 OF 2018 Amol s/o Pramod Dhade Petitioner

Versus

The General Manager (P & IR) & others Respondents Mr.R.O.Awasarmol, advocate for the petitioner. Mr.M.K.Goyanka, advocate for Respondent No.2. Mr.D.A.Madkar, advocate holding for Mr.G.A.Nagori, advocate for Respondent No.3.

CORAM : R.M.BORDE & MANGESH S. PATIL, JJ.

DATE : 08th October, 2018 PER COURT:

It is pointed out that there is only one vacancy available for VJ-A category. However, in view of clause 3.2 of the advertisement, 50% seats are earmarked for trained candidates and the selected candidate belongs to aforesaid category. The employer has chosen to fill the vacancy by appointing trained candidate, which appears to be in consonance with clause 3.2 of the advertisement. The action of appointing Respondent No.3 cannot be said to be erroneous or in violation of terms of the advertisement or the policy adopted by the employer.

Writ Petition is devoid of substance. Hence writ petition stands dismissed.
