The applicant, by this application prays for condonation of delay of 511 days caused in lodging the second appeal. Reasons in support of the prayer for condonation of delay are set out in paragraph Nos. 4, 5 and 7. It is further submitted that laches are not attributed to the conduct of the applicant. He does not benefit from causing delay in preferring the second appeal. 2.

The respondents have been served with court notice. No appearance is entered either in person or through an Advocate. 3.

In the light of the above, this civil application is allowed subject khs/March 2015/8386-13 (d)

to costs of Rs.5,000/- (Rs.Five thousand only) to be paid by the applicant to the High Court Advocates' Bar Library, Aurangabad within a period of 4 (four) weeks from today, failing which this order shall stand recalled and the civil application shall stand rejected. 4.
