The petitioner is challenging the auction of the sand spot. The learned counsel for the petitioner submits that Gramsabha is not taken into confidence by the Respondent authorities before conducting the auction of the sand spot. The same is contrary to the Government Resolution dated 12.3.2013. The petitioner had approached the Collector raising objection. The Collector has not taken any congnizance of the same.

Learned A.G.P. for Respondent Nos.1 to 4 submits that the petitioner has to approach the Committee constituted in this regard.

In view of the fact that the Committee is already constituted to consider such objection, it would be inappropriate for us to entertain the present petition.

The Writ Petition is disposed of with liberty to the petitioner to approach the Committee. In case the petitioner approaches before the Committee, the Committee shall decide the objection of the petitioner expeditiously, preferably within 15 days from the date of filing of the objection. No costs.
