Mr. Thombre, the learned counsel submits that the petitioner is seeking appointment on compassionate ground on account of the death of the husband, who was working with the respondent. The husband of the petitioner worked from 2007 to 2012 and while in service died. The respondents have not yet considered the application of the petitioner.

The learned A.G.P. submits that the nomination in favour of the husband of the petitioner as freedom fighter's nominee is cancelled in 2014.

It is submitted by Mr. Thombre, the learned counsel that the
( 2 ) 956 wp 7796.16 said order cancelling the nomination has been stayed by the Hon'ble Chief Minister.

Be that as it may, the nomination in favour of the husband of the petitioner was cancelled after the death of the husband of the petitioner.

Naturally, it would not be appropriate to direct the respondent to consider the application of the petitioner for appointment on compassionate ground at this stage.

In case the Hon'ble Chief Minister / Government decides in favour of the employee with regard to the cancellation of nomination as Freedom Fighter's nominee, then, the respondents may consider the application of the petitioner seeking appointment on compassionate ground on its own merits.
