Parties have arrived at settlement and agreed to receive amount of pension in the proportion recorded in the terms of settlement.

The terms of settlement are taken on record and marked "X" for identification. The terms of settlement are duly signed by both the petitioners and Respondent No.3. Parties are present before the Court and admit correctness of contents of the terms of settlement.

Learned Standing Counsel appearing for Respondents - employer states that amount of pension would be disbursed as per the entitlement recorded in the terms of settlement placed on record.

{2} wp292411.odt So far as employer is concerned, although the employer is not party to the terms of settlement, since it relates to entitlement of the pension amount and apportionment thereof between legal heirs of deceased employee, it would not be necessary to record signature of the Respondent-employer on the terms of settlement.

As has been stated above, learned Standing Counsel appearing for Respondents No.1 to 4, on instructions, states that appropriate care would be taken to disburse the amount in accordance with entitlement of the parties, recorded in the terms of settlement.
