Learned counsel for respondent-insurance company opposes the application. According to him, there is delay of little over 17 days in lodging the FIR. The rider of the motorcycle has not been made party to the claim petition. He meant to say that he has a very good case in appeal.

It is a death claim. For the reasons given in the application, the applicants are permitted to withdraw 50% of the amount deposited in this Court on furnishing usual undertaking to the

6-ca.3532-21 satisfaction of learned Registrar (Judl.) of this Court. Remaining amount be kept in Fixed Deposit in any nationalised bank till disposal of the appeal 4.

Civil Application stands disposed of.
