The applicant-claimant (original respondent no.1) has preferred this application seeking permission to withdraw the amount in view of disposal of appeal.

Learned counsel for the applicant submits that the appeal was dismissed vide order dated 11th August, 2015 passed by this Court (Coram : N.W. Sambre, J) and award passed by the Reference Court has been upheld. In view of the conditional order granting stay passed in the matter, the appellant-acquiring body has deposited Rs.19,334/- which the applicant is entitled to withdraw together with interest accrued thereon.

Learned A.G.P. submits that in view of disposal of appeal the appropriate orders may be passed.

Since the appeal is disposed of and the award passed by the Reference Court is upheld the application is allowed in terms of prayer clause "B". The amount deposited together with interest accrued thereon be paid to the applicant.

The application is disposed of in above terms.
