Learned A.P.P. submits that the investigation in the matter is over and the investigating officer is likely to file the charge sheet, as even sanction has been accorded for filing of charge sheet by the superior officers.

In view of aforesaid development, learned advocate for the petitioner submits that prayer clause "C" has now become infructuous in view of the supplementary statement been recorded and as regards prayer clauses "B" and "C" are concerned, that can be agitated before the trial court as well, if occasion arises, before this court. Therefore, he be allowed to withdraw the writ petition with liberty to take appropriate proceedings before the appropriate authority after the charge sheet is filed.

Taking into consideration the development that has taken place, we allow the writ petition to be withdrawn, with liberty, as prayed for.
