After hearing the learned advocates for both the sides, when this Court expressed disinclination to grant relief, the learned counsel for applicant, on instructions, seeks leave to withdraw this application. Leave granted. The application is disposed of as withdrawn. The learned counsel for applicant further prayed that the trial may be expedited.
The speedy trial is right of the accused. Therefore, the prayer of the applicant for expeditious trial deserves to be allowed with the following directions:- I) The Trial Court is directed to decide the case as
11 BA.397.2024.odt expeditiously as possible, in any case within three months from today.
II) If the case is not decided within three months, the applicant is at liberty to file fresh application for bail. III) The Trial Court is further directed to conduct the trial in the literal sense of session. Needless to mention that it is a sessions trial and word "sessions" means once it is started it shall not be stopped till it is concluded.
IV) For that purpose, the Trial Court is expected to keep the date twice or thrice in a week and dispose of the case as expeditiously as possible, within three months from today. The applicant to inform the Trial Court regarding this order. The fees of the appointed counsel be paid through the High Court Legal Services Sub-Committee, Aurangabad as per Rules and schedule.
