Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The applicant was not named in the first information report. One of the co-accused made a statement against him that he was supplying the pills to the co-accused which were harmful to the human life. However, nothing has been recovered from him. The co-accused, who were caught red-handed, have been released on bail. Considering the role attributed to him and progress in the investigation against him, he deserves bail. Hence, the order :- i) The application is allowed.

49-BA-392-23.odt ii) Applicant Shaikh Parwez Shaikh Abdul Qadeer be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in C.R.No.104 of 2022, registered with Police Station Begumpura, Aurangabad, for the offence punishable under Sections 328 and 276 read with Section 34 of the Indian Penal Code and Section 22 of the Narcotic Drugs and Psychotropic Substances Act read with Sections 18(a), 18(A), 18(C), 27(Kh)(2) and 28 of the Indian Pharmaceuticals and Cosmetic Act and Sections 4 and 25 of the Indian Arms Act, on the conditions that; (a) He shall not tamper with the prosecution witnesses. (b) He shall not involve in the similar offence.
