The learned Advocate for the applicants was absent on 30.06.2025 and today also there is no appearance on behalf of the applicant.

The present application is filed by respondent nos.4 and 5 in Writ Petition No.12314 of 2024 seeking to recall order dated 17.02.2025 passed in the said petition.

Vide order dated 17.02.2025, writ petition was allowed in terms of prayer clause 'B'. Vide prayer clause 'B' of the Petition, the petitioner/non applicant no.1 had challenged order dated 24.09.2024 passed by the learned C. J. S. D. Ahmednagar below Exhibit 37 in Special Civil Suit No.40 of 2024 on application at Exhibit 37. The prayer in the said application at Exhibit 37 was to decide the application at Exhibit 5 filed in the said Suit. Pursuant to the order Narwade/

15-3138-2025.odt passed by this Court the application at Exhibit 5 is decided by the learned Trial Court vide order dated 13.06.2025. 4.

In view of the above, Civil Application No.3138 of 2024 is rendered infructuous.

Civil Application is disposed of as infructuous, in view of the reasons recorded above.
