The present Criminal Application is u/s 438 of the Code of Criminal Procedure for grant of anticipatory bail since the applicant is apprehending his arrest in connection with Crime No. 02/2015 registered with Peth Beed Police Station, Dist. Beed for the offence punishable u/s 147, 148, 149, 341, 307, 324, 325, 427, 504, 506 of the Indian Penal Code and Sections 3, 25, 27 of the Arms Act.

Heard Mr. Sayyed Tauseef Yaseen, the learned counsel for the applicant, Mrs. V.A.Shinde, the learned A.P.P. for respondent - State.

The First Information Report [for short, 'F.I.R.'] is lodged by one Dharamraj, who is one of the Corporator of Municipal Council, Beed. He has named fifteen persons in the F.I.R. The applicant No. 1 is accused No. 15 in the F.I.R. 4.

According to the learned counsel for the applicant, the first informant has specifically ascribed the role to every accused, which he has named in the F.I.R. except the present applicant. The learned A.P.P. fairly stated before this Court that neither the role is ascribed in the F.I.R. nor there is any incriminating material in the police papers against the present applicant. Statement accepted.

Hence, I pass the following order :

(i) In the event of the arrest in connection with Crime No. 02/2015 for the offences punishable u/s 147, 148, 149, 341, 307, 324, 325, 427, 504, 506 of the Indian Penal Code and Sections 3, 25, 27 of the Arms Act registered with Peth Beed Police Station, Dist. Beed, applicant Amar S/o Tukaram Dhone be released on anticipatory bail on he executing P.R. Bond of Rs. 5,000/- [Rupees Five Thousand] with one solvent surety of like amount.

3 Cr.Apln. 1198.2015 (ii) The applicant is directed to attend Peth Beed Police Station, Dist. Beed once in a week preferably on every Sunday between 3.00 p.m. and 4.00 p.m. till the charge sheet is filed. (iii) Criminal Application No. 1198 of 2015 is disposed of.
