PER COURT :- An affidavit in reply has been filed on behalf of respondent No.3, wherein, in paragraph No.5, it has been stated thus: " 5.

In view of the above order of Hon.High Court, Mumbai dated 24.6.2016, this respondent has instructed all the concerned administrative departments of Mantralaya to implement the said order subject to final decision in proposed Special Leave Petition. Copy of the letter dated 27.7.2016 is annexed hereto as EX-B. Hence in the light of provision of GR., FD. Dated 1.4.2010 and clarification given to point No.2 to 13 of GR., FD dated 1.7.2011 the Respondent No.1 and 2 can examine the fitness of Petitioner and on examining if he is found fit, the said Respondents can grant him second benefit as prayed by him in WP, however subject to final

" In view the contentions raised in the affidavit in reply, respondent Nos.1 and 2 are directed to examine the eligibility of the petitioner for grant of second benefit, as prayed by him and if found eligible grant the benefits, subject to final decision in the proposed SLP. The respondents shall consider eligibility of the petitioner for grant of second benefit, as requested by him, as expeditiously as possible and preferably within three months from today and it is accordingly directed.
