Mr. V.D.Hon, learned Senior Advocate, submits that the petitioner was given admission to First Year B.A.M.S.Course and, at the fag end of the First Year, it was stated that, the admission of the petitioner would be cancelled. The petitioner approached this Court by filing instant writ petition. The Court had protected the admission and allowed the petitioner to appear for the examination subject to result of the petition. The result of the petitioner's first, second and third years examination has been declared, however, result of the fourth year examination has been withheld. 2.

BENCH AT AURANGABAD (2) CA NO.3426/2017 question is about basic eligibility of the petitioner as, in the XIIth Standard, petitioner did not have Biology subject and instead, had taken Bio-Technology subject.

It appears that, under the orders of the Court, the petitioner is allowed to appear for the examination and the results were also declared for the first, second and third year B.A.M.S.Course.

The internship also would be almost of one year. 5.
Considering the above, the respondents shall declare the result of the petitioner's fourth year B.A.M.S. examination and if the petitioner is otherwise eligible, may be considered for internship that would be subject to the decision in the writ petition.
