The learned counsel for the appellant insurance company seeks deletion of respondent No.2 i.e. driver of the offending vehicle being not necessary party.

The name of respondent No.2 be deleted at the risk of appellant - insurance company. Deletion be carried out forthwith. 3.

The appellant - insurance company is seeking condonation of delay of 336 days, which appears to be caused due to obtaining sanctions at various stages. There is no strong objection from other side and therefore the delay of 336 days stands condoned. 4.
