Proceedings being Misc. Application No.36 of 2017 pending on the file of District and Sessions Judge, Latur and Hindu Marriage Petition No.14 of 2017, of which, transfer is sought by the applicant-wife to the Court of District Judge at

56.17mca (2) Beed and to the Court of Civil Judge, Senior Division at Beed respectively.

The said prayer is opposed on the ground that other proceedings under Section 9 of Hindu Marriage Act initiated by the respondent are pending in the court at Latur.

Having regard to the fact that the issue is in relation to the custody of minor, who is presently residing with the applicant, it will be appropriate, in my opinion, to allow both the applications.

Misc. Civil Application Nos. 56 of 2017 and 57 of 2017 stand allowed in terms of prayer clause (B).
