IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 924 WRIT PETITION NO.4241 OF 2022 SURYABHAN MARUTI GHANWAT AND ANOTHER

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS Mr. Nanabhau R. Thorat, Advocate for the petitioners Mr. A. R. Kale, AGP for the respondents/State CORAM:RAVINDRA V. GHUGE & ANIL L. PANSARE, JJ.

DATE:01st July, 2022 P. C.

1.

The petitioners have putforth prayer clause 'B' as under:- B] By issuing writ of mandamus or any other appropriate writ of direction in like nature respondents may kindly be directed to pay the rental compensation and direct the respondents to decide representation dated 25-10-2021 and 1711-2020 as early as possible within stipulated period.

(2) 2.

The learned AGP opposes, contending that the whole claim has been putforth by the petitioners in the representation and directing the decision on the representation would amount to revival of a stale cause of action.

3.

We are of the view that if the petitioners were entitled for rental compensation and the competent authority is under a mandate to pay him the said amount, a decision on the representation may resolve the issue.

4.

In view of the above, this petition is disposed off with the direction to respondent No. 3 to consider and respond to the said representation as expeditiously as possible and preferably on or before 15-10-2022. If he needs

(3) any assistance from the petitioners, he would be at liberty to call upon the petitioners to tender documents or information, as the case may be. [ANIL L. PANSARE, J.] [RAVINDRA V. GHUGE, J.] VishalK/wp4241.22
