By order dated 05.01.2021 this Court in Writ Petition No.9051/2020 had directed that Scheduled Tribe Certificate Scrutiny Committee, Nandurbar should conclude the proceeding regarding validation of the tribe certificate of the petitioner within one month from the date of appearance of the petitioner, fixing the date of appearance of the petitioner before the committee on 11.01.2020.

Alleging non-compliance contempt petition has been filed.

Though the present is a contempt petition nonetheless Court had requested Mrs. V.S. Choudhari learned AGP to obtain instructions as to the status of the validation proceeding.

Today when the matter is called upon, she submits that report from the vigilance cell is yet to be received by the committee and once the report is received the committee shall take an appropriate decision in accordance with law.

Learned counsel for the petitioner submits that petitioner had completed B.E. examination but because of non-availability of tribe validation certificate his further studies have been jeopardized. 7.

On a query by the Court learned AGP submits that upon receipt of vigilance report the committee would be in a position to decide and conclude the validation proceeding within a period of two months. 8.

Considering the order dated 05.01.2021, we direct respondent no.2 i.e. Scheduled Tribe Certificate Scrutiny Committee, Nandurbar Division to conclude the validation proceeding of the scheduled tribe certificate of the petitioner within a period of one month from the date of receipt of a copy of

( 3 ) this order and thereafter to pass a speaking order with due intimation to the petitioner.

Contempt Petition is disposed of.
