The grievance of the petitioner is that the petitioner was awarded higher compensation than claimed in the reference. However, while passing the operative part, the petitioner is not given benefit and the compensation is even not yet paid. 2.

We have heard Mr. Sangle, learned AGP for the State. 3.

In fact, while filing the reference, the claimant is not required to claim a specific sum of amount. He has only to file a reference seeking enhanced compensation. In case the claimant is awarded higher compensation, then certainly the petitioner would be entitled for the higher compensation, subject to payment of the court fees.

The petitioner may make an application to the court for payment of the compensation as may have been arrived at by the court in the award.

The petitioner is permitted to pay the deficit court fees. 6.

The said application shall be decided by the court on its own merits.

The Writ Petition is disposed off. No costs.
