Heard Shri. A.U. Deshmukh, the learned Counsel appearing for the applicant and Shri.B.R. Surwase, the learned Counsel appearing for the acquiring body.

The present application is filed by one of the applicants in Land Acquisition Reference No.246/2011, the award passed wherein is challenged in the present appeal. The learned Reference Court has awarded compensation to all the three claimants in equal proportion. 3.

Since the present application is filed by only one of the claimants, I deem it appropriate to allow the said applicant to withdraw 1/3rd of the deposited amount on furnishing an undertaking to the satisfaction of the

Balance amount be invested in FDR in any nationalized Bank initially for the period of two years and if so required, for further period till disposal of the appeal. Civil application stands disposed of. Order accordingly.
