In Civil Application No.4524/2012, respondents are yet to be served. In other matters service is complete. 2.
Delay of 1624 days has been caused by the State in preferring the present appeals. When a query was made and the record was perused, it is noticed that the Reference Court, in all these matters, has enhanced the amount of compensation by Rs.398/- per Are. It is further noticed that in First Appeal Stamp
No.7160/2012, the acquired land was admeasuring 12 R. In First (2) CA NO.4524/2012gr Appeal Stamp No.7194/2012, the acquired land was 10 Are whereas in First Appeal Stamp No.7200/2012, the acquired land is 15 Are. It is, thus, evident that the amount of enhanced compensation is maximum of Rs.6000/-. The present appeals and applications are filed in the year 2012 and since then the matters have not moved further. In view of the fact that the compensation enhanced is meager and having regard to the fact that the acquisition is of the year 1986, there seems no propriety in now entertaining the present appeals. Even in the application for condonation of delay, huge delay of 1605 days has not been properly explained. For all these reasons, I am not inclined to condone the delay. As discussed by me, even otherwise, there seems no merit in the appeals filed by the State. For the reasons stated above, the following order is passed:
ORDER
1.
The Civil Applications seeking condonation of delay stand rejected. Consequently, the First Appeals on Stamp number also stand rejected. Pending Civil Applications, if any, stand disposed of.
