By this Civil Application, the applicant seeks to implead Mr. Mohan Desle, Present Education Officer (Secondary), Zilla Parishad, Dhule as respondent No.5 in Contempt Petition No.34 of 2020. According to the applicant, said Mohan Desle is the new incumbent in place of the earlier Education Officer. 2.
Civil Application is allowed in terms of prayer clause "B". 3.
Amendment shall be carried out within a period of one
(1) week from today.

Issue notice to respondent No.5, returnable on 20.04.2022.

It is made clear that this notice is not a notice under the provisions of Contempt of Courts Act, 1971.

Mr. Panpatte, learned counsel for the petitioner-applicant invited our attention to the order dated 23.02.2021 passed by this Court recording the statement made by the learned AGP that the payment in respect of the period from 2017 onwards would be possible within a period of two (2) weeks, which is for the period of 2013 onwards. The learned AGP tenders a copy of the letter dated 25.03.2022 addressed by the Education Officer (Secondary), Zilla Parishad, Dhule to the learned AGP stating that the issue regarding payment is now pending before the Director of Education, Pune.

It is made clear that if an appropriate decision is not taken by the Director of Education on the said proposal dated 25.03.2022, this Court would be constrained to initiate proceedings under the provisions of Contempt of Courts Act against the Director of Education as well as the respondents,
who are responsible for not complying with the order passed by this Court.
