This is an application filed by the applicants to release them on bail in connection with Crime No. 61/2014 registered with police station Dhule City, Dhule, for the offence punishable u/s 395, 385, 341, 323, 504, 506 of the Indian Penal Code, u/s 3 read with 25 of the Indian Arms Act and u/s 3 (1) (2), 3 (2) and 3 (4) of the MCOC Act. 2.
When this matter was taken up for hearing, learned A.P.P., upon instructions from the Investigating Officer
2 Cr.Apln. 1220.2015 who is present in the Court hall, made statement that the learned Special Judge has already framed Charge and the trial has already commenced. Statement accepted.

In view of the statement of the learned A.P.P., learned counsel for the applicant submits that he wish to withdraw the present Criminal Application.

The present Criminal Application is dismissed as withdrawn.

The prayer made by the learned counsel for the applicant for direction to dispose of the trial within stipulated period is just. In that view of the matter, the learned Special Judge, Nasik [MCOC Act], who is in-charge of Special Case No. 1/2014 is directed to decide it within the stipulated period, not later than ten months from the date of receipt of this Order. The applicant shall co-operate with the learned Special Judge for the early disposal. It is expected from the Special Judge that the matter will be taken up on day to day basis.

With these observations, the present Criminal Application is disposed of.
