The learned Advocate for the petitioner submits that this petition was circulated for withdrawal as the petitioner has instructed the learned Advocate that this petition can be withdrawn since the petitioner has arrived at an understanding with the respondent bank to settle the loan accounts under the O.T.S.

The learned Advocate for the respondent bank confirms the said statement.

In view of the above, this petition is disposed off on instructions. 4.

Needless to state, the amount of Rs.35 Lakhs deposited by the petitioner with respondent no.1 bank, would be adjusted as against the O.T.S. 5.
