The learned Advocate for the petitioner / Management tenders a compilation of 5 pages which are taken on record and collectively marked as 'X' for identification. 2.
He further submits that the respondent has attained the age of superannuation from employment with effect from 31/05/2016. He has already been paid his retiral benefits and this petition has, therefore, become infructuous. 3.
I find from the order dated 05/05/2004 passed by this
5-wp-3771-03.odt Court that the statement of respondent No. 1 / employee was recorded that he was giving up the entire claim for back wages. Based on such declaration, the petition was admitted and the petitioner / Management was directed to reinstate the employee forthwith. So also, respondent No. 2 / Education Officer was directed to grant provisional approval and clear the pay bills of the employee.

In view of the above, this petition is rendered infructuous and stands disposed off.

Rule is discharged.
