Mr. Patil, learned Counsel for the petitioner states that the proposal was moved with the respondent, seeking permission to open B.S.W. & M.S.W. Courses in the year 2009-2010. The said proposal was moved with the respondent No.4 on 17.10.2008. Respondent No.4 forwarded said proposal with its recommendation. However, respondent No.2 without considering letter or orders, rejected the proposal. The learned Counsel submits that same was erroneous.

The learned A.G.P. states that the policy decision was taken by the State Government not to grant permission to open new social work college in the State of Maharashtra.

It would be for the State Government to determine policy of granting permission to open particular courses at the particular place. As policy decision was taken, it would not be possible for this Court to interfere in the said order. In-case, it is permissible, then the petitioner may move fresh proposal, which can be considered on its own merits by the respondent-State.
