CORAM : T.V.NALAWADE DATE : 21/06/2016 PER COURT :- The application is filed by wife for transfer of Marriage Petition No.321/2014 presently pending in Family Court-2, Pune to the Court of Civil Judge, Senior Division, Latur.

2] Notice was served on the husband, but he has not turned up. Heard learned counsel for applicant.

3] It is the case of wife that she is house wife. She is not earning any income. She is to take care of her son so she is facing difficulty to attend the Court at Pune. It is her case that she cannot afford to spend on conveyance and attendant and so she may not be able to

-2contest the matter filed for divorce. It is her case that there are 2 proceedings filed against husband at her instance in Latur Court and no inconvenience will be caused to husband if all the 3 matters are brought at one and the same station.

4] In view of above circumstances, Application is allowed. The proceedings at family Court at Pune be withdrawn and is transferred to the Court of Civil Judge, Senior Division, Latur. The new Court to take care and see that the date of present matter matches with the dates fixed in other two matters which are filed by wife in Latur Court. 5] The new Court is to issue notice on Court motion to the husband as the husband has not turned up in the present proceeding. Only after service of proceeding on husband, hearing of proceeding is to be started.
