Heard both sides. The applicants are permitted to delete the name of applicant no.3 as appearing twice in the title clause of the application.

Learned counsel submits that, deceased appellants were prosecuting the second appeal and the legal heirs were not having any knowledge about the pending appeal and as such, delay caused in filing the application for substituting them as legal representatives of deceased appellant. 3.

Heard learned counsel for respondent.

In view of the above and for the reasons stated in the application, application is allowed in terms of prayer clause B, C and D. CA accordingly disposed of.
