Learned counsel for the petitioner submits that in view of the settlement arrived at between the parties, nothing further survives for consideration in the writ petition and seeks permission to withdraw the writ petition. Learned counsel further submits that, during the pendency of the Tax Appeal, an amount of Rs.25,00,000/- came to be deposited before the Trial Court.

Writ Petition is disposed of as withdrawn.

Petitioner is permitted to take out an appropriate application before the Trial Court for withdrawal of the amount, if any, deposited which the Trial Court will consider on its own merits and in accordance with law.
