DATED : 27th March, 2015 PER COURT :- 1] This is an application for anticipatory bail moved by the applicant apprehending his arrest in connection with Crime No.18 of 2015, registered at Renapur police station, for the offences punishable under Sections 353, 294, 323, 504 of the Indian Penal Code.
2] I have heard learned counsel for the applicant and the learned Additional Public Prosecutor for the respondent/State.
3] From the first information report, even the entire allegations made in the first information report are taken at its face value, the only allegation against the present applicant is that at the time of job of spreading of black soil in the school, the applicant came there and he used abusive words against the first informant.
4] Offence under Section 353 of the Indian Penal Code is non-bailable and all other offences are bailable offences. 5] Looking to the allegations of accusation, it is absolutely clear that there would be no purpose at all for granting custodial presence of the present applicant.
crap1237.15 6] In that view of the matter, application needs to be allowed.
7] Hence, I pass following order.
(i) Criminal Application is allowed.
(ii) In the event of arrest of the applicant in connection with Crime No. 18 of 2015, registered with Renapur police station, for the offences punishable under Sections 353, 294, 323, 504 of the Indian Penal Code, he shall be released on anticipatory bail on he executing P.R.bond in the sum of Rs.5,000/- with one solvent surety in the like amount. (iii) The applicant shall attend police station Renapur once in a fortnight in between 10.00 a.m. to 11.00 a.m. Preferably on Sunday.
(iv) With this, application is disposed of.
