One of the appellant at sr. no.2 in the aforementioned appeal has filed this application through Advocate Mr. Z.M.

Avhad, praying therein for suspension of sentence and subsequently releasing the appellant no.2 on bail during pendency of the appeal. Since the appearance of Advocate Mr. Mukul S. Kulkarni continues for the appellants including the appellant no.2-Umesh Ishwar Patil, therefore, the present application at the

1270.17appln instance of appellant no.2 through Advocate Mr. Z.M. Avhad cannot be entertained. In case, the appellant no.2 is advised to file separate appeal, in that case, unless the procedure as contemplated under the Bombay High Court Appellate Side Rules is followed, Registry shall not accept the separate application/ appeal/proceedings at the instance of the appellant no.2 - Umesh Ishwar Patil.

In the light of above, at present there is no question of granting any relief. Hence, the application stands disposed of.
