In pursuance of notice issued to respondents, one Ajinath Raosaheb Lagad, working as Police Head Constable has filed affidavit-in-reply. Para 8 of the said affidavit-in-reply reads thus :

The deponent most respectfully says and submits that during the course of investigation statement of petitioner was recorded, wherein she has named the vehicle in accident was provided by Maruti Suzuki showroom and there is no concern of the Vehicle of applicant as the vehicle

Cri.Appln.No.1240/2015 involved in accident was Maruti Alto while Applicant's vehicle is Maruti Swift Dzire which bears the same No.MH-23-AD-0877.

She further stated that at the relevant time, her vehicle was in house and no any accident was occurred. The vehicle involved in the accident was Maruti Alto while the applicant's vehicle is Maruti Swift Dzire bearing same number i.e. MH-23-AD0877.

The learned counsel appearing for the applicant is satisfied with the averments in para No.8 of the affidavit-in-reply. in that view of the matter, he seeks permission to withdraw the criminal application.
