Heard the learned Counsel for the petitioner, the learned AGP for the State, and the learned Counsel for respondent No.3. 2.

It appears from the impugned order that the delay has been condoned and that an inquiry on merits is contemplated. The order records that the competent authority shall conduct the inquiry. It is further stated that the authority will verify whether the area of the respondent is reduced after the Consolidation Scheme and the same has been allotted to the petitioner, and whether such allotment has been made by following the procedure contemplated under the Act. It is further observed that upon such verification, the authority shall proceed to pass appropriate orders. 3.

In the factual situation, the parties agree that before passing the final Page 1 of

968 WP 3937-2025 order, the authority should, after verification of the record, give them an opportunity of being heard. Thus, this Court directs the authority to issue notice to all affected parties, after verification of the record and hearing the affected parties, the authority shall proceed to pass the final order. 4.

All contentions are left open to be raised before the authority, after notice is issued to all parties. With these observations, the petition stands disposed of.
