Parties in the appeal have settled the matter out of the Court. They have also executed a compromise pursis containing the consent terms. The compromise pursis is duly verified before the learned Registrar, (Judicial) of this Court. The learned Registrar, (Judicial) has also submitted the report dated 01.08.2024.

In terms of the compromise the appeal is disposed off.

The compromise pursis shall be the part and parcel of the decree.

The Second appeal stands disposed off.

The judgment and decree of the appellate Court is set aside and merged into the terms of the compromise. 6.

It is informed that the execution proceedings are pending in the Court of C.J.J.D. Bhoom, bearing Darkhast No. 29 of 2003 and 35 of 2003 executing Court to dispose off the both the execution proceedings in terms of the compromise pursis.

7.

The pending Civil Applications, if any, stands disposed off.
