Though it appears that the Executive Engineer, Medium Project Division, Osmanabad was a party respondent No.2 to the reference, the present applicant is coming with a case that the Corporation was not party and therefore filed this application for grant of leave. It appears that said respondent No.2 before the reference Court was represented by Advocate from the panel of the Corporation. It appears that he never objected to the nomenclature or name of the party respondent No.2. Under such circumstance, it will have to be considered that Corporation was party. There is absolutely no necessity to file such application yet. Since it is filed and it is of formal nature, it is allowed. Application stands disposed of accordingly. ( Smt.
