I have heard the learned Advocates for the respective sides at length.
The learned AGP submits that in summary proceedings under Section 14(1)(g) of the Maharashtra Village Panchayats Act, there is no procedure for recording of examination and cross-examination. He further submits that one witness out of the two witnesses proposed by the Petitioner, is Mr.C.N.Lokare, who is the erstwhile Gram Sevak and who is also subjected to the investigation on account of being a party to the misappropriation along with the Petitioner.
The learned Advocate for the Petitioner submits, on instructions, that the Petitioner would tender affidavits of Mr.T.J.Jadhav
*2* 909wp2926o18 and Mr.C.N.Lokare on 02.04.2018 before the District Collector and thereafter, would not seek any adjournment or any opportunity for placing on record any further affidavits.
Considering the above, this Writ Petition is disposed of by recording that the Petitioner would file the affidavits of the above said two persons on 02.04.2018 before the District Collector. Beyond the said two persons, the Petitioner will not be permitted to place any further affidavit of any person and will also not be permitted to seek any adjournment. Needless to state, after the said affidavits are filed on 02.04.2018, the District Collector would proceed with the said proceedings expeditiously and would be at liberty to refuse adjournments to the parties, if reasons appear to be trivial. kps (RAVINDRA V.
