The Second Appeal is filed only to the extent of enhancement of the amount as a suit was filed for recovery of amount. 2.

Now a pursis is filed stating that the parties have settled the dispute out of the Court. In view of the settlement, appellant already has received some amount in the execution. Now by way of the settlement, appellant is accepting the demand draft of Rs. 1,25,000/- towards full and final settlement and withdraws the Second Appeal. The appellant is personally present before the Court. The learned Advocate for the respondent has handed over the demand draft for amount of Rs. 1,25,000/-.

The same is accepted by the appellant.
