Learned counsel for the petitioner seeks leave to withdraw the petition to the extent of prayer clause (C) which is as follows : C) For a writ of certiorari, order or direction in the nature of certiorari calling for the record and proceeding of the Order dated 19.04.2018 (Exh. 'K'), issued by the respondent No.1 and after examining the legality, validity and propriety thereof, the said Order may kindly be quashed and set-aside to the extent of petitioners Nos.2 and 3 with further direction to the respondents herein to grant permission to the petitioners Nos. 2 and 3 to start 8th Std. on grant basis from the academic year 2017-18.

Learned counsel for the petitioner submits that he would not press the petition for the above prayer and would file independent petition for agitating the grievance concerned. Writ petition is

2 928.WP-3378-2020.doc disposed of to the extent of prayer clause (C) with a liberty to file the fresh petition.

Another prayer in the petition pertains to non consideration of the proposal dated 27.09.2019 submitted by the petitioner/management to the respondent no.4. 5.

Learned counsel for the respondent no.4 would submit that the proposal would be considered on its merit. In view of the statement we dispose of petition to the extent of prayer clause (A) also by issuing direction to respondent no. 4 to consider proposal dated 27.09.2019 and decide it on its merit expeditiously.
